Electric Scooter Legality and Regulations in Colorado: 2026

 Electric Scooters are legal - within the relevant regulations

Colorado law differentiates between "Low-Power Moped" (Vespa-style, seats) and "Electric Scooters" (stand-up devices like the Bo Model M).

 

While Vespa-style seated Moped requires a license and insurance, stand-up electric scooters like Bo Model M are regulated under CRS § 42-4-221, which mandates that they be treated with the same rights as Class 1 Electric Bicycles.

Licensing and Regulations

License: stand-up electric scooters (weighing <100 lbs and max 20 mph) do not require a driver’s license, insurance, or registration in Colorado.

The "Parity" Rule: State law expressly prohibits local municipalities from passing rules for e-scooters that are more restrictive than those for Class 1 e-bikes.

This means if a Class 1 e-bike is allowed without a license, your Bo Model M is too.

Equipment and Performance Limits

Speed & Power: The motor must not exceed 750W, and the device must be limited to 20 mph on level ground.

Braking: Must be able to come to a complete stop from 10 mph within 25 feet (in practise, any scooter which cannot do this ought not be ridden anyway..!)

Visibility: For night riding, a front white lamp visible from 500 ft and a red rear reflector are mandatory.

Sirens and whistles are strictly prohibited.

Permitted Riding Areas

Roadways: Permitted on streets with speed limits of 30 mph or less (this was recently lowered from 35 mph in several cities like Denver to prioritize safety).

Bike Lanes & Trails: You have full access to bike lanes and multi-use trails unless a specific local ordinance bans all motorized devices.

Sidewalks: In Denver, sidewalk riding is illegal unless you are within one block of your starting point or destination. In those instances you must yield to pedestrians and stay under 6 mph.

In Boulder, sidewalk riding is entirely prohibited citywide.

Summary of Key Local Changes (2025)

Denver: New "Sidewalk Sensors" are being mandated for rental-scooter fleets to force them onto the road. 

As a private Bo owner, you must manually ensure you stay off the sidewalk to avoid fines.

Colorado Springs: As of July 2025, the city has expanded access for e-scooters on select urban trails.
