Electric Scooters are legal - within the relevant regulations


On August 21, 2025, the Governor signed House Bill 114. This ended the total ban on e-scooters and introduced a new legal category for Motorized Scooters.

Delaware has moved from a total ban to a regulated access. A new classification has been carved out for vehicles like the Bo Model M .

The New Category: Low Speed Motorized Scooters

Under the 2025 amendment to 21 Del. C. § 4198N, an e-scooter is now legally classified as a Low Speed Motorized Scooter if it:

Cannot travel faster than 15 mph on a level surface.

Is used by a private owner (commercial rental fleets like Lime/Bird remain prohibited statewide).

Rights and Privileges

Bicycle Parity: Operators of these vehicles are now granted the same rights and privileges as bicyclists.

No Licensing or Registration: You are no longer required to have a driver’s license, insurance, or registration to operate a low-speed electric scooter.

The "Signed Statement" Rule: The requirement for sellers to obtain a "witnessed statement" acknowledging the ban has been repealed for scooters meeting the new low-speed definition.

Age and Safety

Minimum Age: You must be at least 14 years old to operate a low-speed scooter on public infrastructure.

Helmet Laws: Helmets are mandatory for all operators and passengers under 18 years of age. The previous law was under 16; this has been changed to align with e-bike standards.

Permitted Riding Areas

Roadways and Bike Lanes: You may now ride on any public road where bicycles are permitted, as well as designated bike lanes and multi-use paths.

Sidewalks: Despite the new freedom on roads, sidewalk riding remains strictly prohibited in Delaware. You must stay in the street or bike lane.

Night Riding: Standard bicycle lighting requirements apply: a white front light and a red rear reflector or lamp.
