Electric Scooters are legal - within the relevant regulations
There is no single "Idaho E-Scooter Statute," however the state now officially recognizes the authority of cities to treat electric scooters with the same legal parity as Class 1 and Class 2 e-bikes (Idaho Code § 49-724).
Boise 2026 Speed and Power Regulation
Boise remains the most regulated city in the state. Under the October 2025 "Safe Streets" Update, the city redefined the electric scooter category:
Power regulation: 300W - To be legally classified as an "E-Scooter" in Boise (allowing you on the Greenbelt and sidewalks), the device must have a rated motor power of 300 watts. To understand the difference between rated and peak power contact us hello@bo.world
Speed regulation: 15mph - To be legally classified as an "E-Scooter" in Boise (allowing you on the Greenbelt and sidewalks), the device must have a rated motor power of 300 watts.
New Curfews: Shared rental scooters (e.g. Lime) are capped at 10 mph in Downtown Boise after 6:00 PM.
While private owners are not yet software-locked (in the same way as the rental fleets) it is clearly necessary to observe the local regulations on speed to ride legally.
Meridian and Moscow regulation:
Meridian: As of 2025, Meridian has some of the clearest language in the state. E-scooters are permitted on paved surfaces in parks and on city pathways. Unlike Boise, they focus on "Reasonable and Prudent" speed rather than hard wattage caps, making it a friendlier environment for premium devices.
Moscow: Under Ord. 2022-04, Moscow granted e-scooter riders the same rights and responsibilities as bicyclists. You are welcome in bike lanes and on roadways, provided you follow the flow of traffic.
Operational Requirements
Sidewalks: Sidewalk riding is allowed statewide unless a city-specific "Business District" ban is in place. You must always yield to pedestrians and give an audible signal when passing.
Equipment: A front white light and a red rear reflector are mandatory for night riding.
Age & License: No driver’s license is required state-wide. There is no state-wide minimum age, but Boise requires riders to be 18+ for rentals. 16+ is the standard for private scooter operation.

2026 Legal Alert: Dismount Zones
Boise State University has significantly expanded its "Pedestrian Priority Zones" (The Quad, "B" Plaza). In these areas, all riders must fully dismount and walk their device. Failure to do so can result in immediate impoundment or a city citation.
